movarae is an online platform that connects users with moving companies. We provide a comparison service that allows users to request quotes from multiple moving companies based on their specific moving requirements.

Our Services include:

• Connecting you with suitable moving companies
• Facilitating the receipt of quotes from moving companies
• Providing information and resources related to moving

We do not provide moving services ourselves. We are strictly a third-party intermediary that connects users with moving service providers. Any contract for moving services is solely between you and the moving company you choose to hire.

3. Eligibility

To use our Services, you must be at least 18 years of age and have the legal capacity to enter into binding contracts. By using our Services, you represent and warrant that you meet these requirements.

4. User Accounts

• We are not responsible for the quality, safety, legality, or reliability of the services provided by the moving companies
• Any contract for moving services is between you and the moving company only, not with us
• We are not a party to any transaction between you and a moving company
• We do not guarantee that you will receive quotes or services from any moving company
• We have no control over and take no responsibility for the actions or omissions of any moving company
• We are not liable for any damages, losses, delays, or disputes arising from services provided by any moving company

While we make efforts to work with reputable moving companies, we make no representations or warranties regarding their services. We strongly recommend that you conduct your own due diligence before engaging any moving company, including checking reviews, verifying licenses and insurance, and getting written agreements.

7. Fees and Payments

Our quote comparison service is free for users. We receive compensation from the moving companies in our network when they provide services to users who found them through our platform.

Any fees or charges for moving services are determined by the moving companies themselves. You are responsible for paying the moving company directly for any services you choose to purchase from them.

8. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by movarae, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We make no warranty that:

• The Services will meet your requirements or expectations
• The Services will be available on an uninterrupted, secure, or error-free basis
• The quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content or information available through the Services
• The moving companies in our network will provide satisfactory or quality services
• Your moving experience will be successful, timely, or free from problems

You acknowledge and agree that your use of our Services and any engagement with moving companies found through our platform is at your sole risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL movarae, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM:

• THE USE OF, OR INABILITY TO USE, THE SERVICES
• ANY ACTIONS OR OMISSIONS OF ANY THIRD-PARTY MOVING COMPANY
• ANY MOVING SERVICES PROVIDED TO YOU
• ANY DAMAGE TO YOUR PROPERTY DURING A MOVE
• ANY DELAYS, CANCELLATIONS, OR ISSUES WITH YOUR MOVE
• ANY CONDUCT, COMMUNICATION, OR CONTENT OF ANY THIRD PARTY

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO movarae, IF ANY, FOR USING THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN movarae AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless movarae, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Termination

We may terminate or suspend your access to all or part of the Services, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

13. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of Ontario, Canada, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of Ontario, Canada. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

15. Miscellaneous

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and movarae concerning the Services.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
